Top 3 Traits to Look for in a Medical Expert Witness

When a case hinges on medical facts, the right expert witness can make or break your argument. Whether it’s a complex medical malpractice claim or a personal injury lawsuit, a qualified medical expert provides the credibility and clarity juries need to understand technical evidence. But not all experts are created equal—and finding one who can withstand cross-examination and communicate persuasively is key.

Here are the top three traits attorneys should prioritize when selecting a medical expert witness:

1. Your Medical Expert Witness Needs Relevant, Verifiable Credentials and Clinical Experience

A solid educational background is the baseline, but real-world clinical experience in the relevant specialty—specifically extensive clinical experience—is what makes an expert’s opinion truly persuasive. Juries and judges tend to give more weight to physicians who actively practice in the same field as the case at hand, particularly in medical malpractice cases. (For example, in a birth injury case, an OB-GYN with a current hospital affiliation and years of labor and delivery experience is far more compelling than a general practitioner who hasn’t delivered a baby in decades.) An expert’s medical background and their reputation within the medical community are also crucial for establishing credibility.

Key questions to ask:

  • Are they board-certified in the relevant specialty?
  • Are they currently practicing or have they practiced recently in the same setting (hospital, outpatient, trauma, etc.)?
  • Do they have experience with the specific condition or procedure central to your case?
  • Do they adhere to current medical standards in their practice?

AMFS in action: Dr. David Carpenter, physician and Director of the Institute for Health and the Environment and an expert on Polychlorinated Biphenols (PCBs), testified for the plaintiffs on PCB exposure they claim left them with brain damage. Dr. Carpenter’s participation in numerous studies related to PCBs made him uniquely qualified to testify on the effects of PCB exposure. His testimony helped clarify medical facts and present medical evidence to the court, supporting the plaintiffs’ claims.

The result? A judgment in favor of the plaintiff for $185.15 million.

2. The Right Medical Expert Witness Has Strong Communication Skills

A highly credentialed expert means little if they can’t effectively explain complex medical concepts to a lay audience. Your ideal witness should be able to break down jargon into plain language without sacrificing accuracy, and clarify complex medical issues for the court. They should remain calm, confident, and composed under pressure—especially during cross-examination.

A great medical expert knows how to tell a clear, consistent story supported by evidence. They should provide valuable insights that help the jury understand the case, avoid speculation, stay within the scope of their expertise, and explain their reasoning in a way that helps the jury connect the dots.

Red flags to look for:

  • Overuse of technical terms without explanation
  • Rambling or inconsistent responses
  • Overconfidence or an argumentative tone under questioning

AMFS in action: Dr. Suresh Moolgavkar, a medical doctor, epidemiologist and mathematician, testified for the defense and established doubt that mesothelioma is always related to asbestos exposure by explaining concepts such as “signal tumor” and spontaneous generation of tumors. The expert’s testimony provided valuable insights into the complex medical issues at the heart of the case.

The result? The jury unanimously ruled in favor of the defense while deliberating for only a few hours.

3. The Best Medical Expert Witness has Courtroom Testimony Experience and Objectivity

An expert’s past experience in legal settings matters—especially when it comes to writing expert reports, participating in legal proceedings and legal cases, preparing for deposition, and presenting testimony at trial. Thorough preparation and practice sessions are essential parts of readiness for court. A seasoned expert knows what to expect in the courtroom and can anticipate the kinds of challenges opposing counsel may raise.

However, objectivity is just as important. Judges and juries can quickly spot someone who always testifies for one side or who stretches their opinion to fit the attorney’s narrative. The most credible experts are those who take their role seriously and demonstrate a commitment to impartiality.

What to look for:

  • A balanced history of working for both plaintiffs and defendants
  • Experience testifying under oath in depositions and trials
  • A reputation for sticking to facts and evidence—not advocacy
  • Experience reviewing medical records, conducting independent medical exams, and presenting expert witness testimony in court

AMFS in action: Dr. Micheal Zeide, an orthopedic surgeon, testified for the defense in a personal injury case that alleges a knee injury was the result of a car accident. Dr. Zeide used anatomical props and referenced medical reports and MRI images to support his testimony. His thorough review of medical records and independent medical exams played a crucial role in supporting the defense’s legal arguments.

The result? The judge’s ruling favored the defense.
