While the expertise behind a medical expert witness and an IME is similar, their functions in the legal system are very different. So, what is the difference between a medical expert witness and an independent medical examiner?
Medical Expert Witness
Medical expert witnesses review medical records pertaining to the case. They do not physically examine the injured party. The purpose of their review varies from determining if a case has merit to writing reports or affidavits based on the information in the records. Medical expert witnesses may also be called to testify on their findings if a case proceeds to trial. Medical expert witnesses are often used in medical malpractice, workers’ compensation, insurance fraud, and personal injury cases.
Independent Medical Examiner (IME)
An IMEis a neutral third-party expert who physically examines the injured party at the request of either the plaintiff or defense. The IME may assess damages, future treatment options or a person’s physical and mental capacity depending on the needs of the case. IMEs can also conduct Compulsory Medical Examinations known as a CMEs. CMEs function the same way as an independent medical exam, however the CME is recorded with either audio or video. IMEs are most commonly used in workers’ compensation and personal injury cases.
